Petitioner has laid this bail application under Section 439 Cr.P.C. arising out of FIR No.38/2017 registered at Police Station Kuchera, District Nagaur for offences under Sections 66E & 67A of the I.T. Act and Section 6/7 of the Indecent Representation of Women (Prohibition) Act.

Police after investigation has submitted charge-sheet in the matter against petitioner and another accused person.

It is argued by learned counsel that petitioner has been falsely implicated in the matter. Learned counsel has further submitted that in fact his mobile phone was used by main accused Sharif Khan and he was responsible for sending indecent photographs on WhatsApp group using that mobile phone. Learned counsel has also submitted that Sharif Khan himself has

admitted all these facts. Lastly, learned counsel has urged that after investigation charge-sheet in the matter has already been filed and petitioner is in custody since 23^rd of August, 2017, therefore, he may be enlarged on bail.

Learned Public Prosecutor has opposed the bail application of petitioner.

Having regard to the facts and circumstances of the case, without expressing any opinion on merits of the case, I feel persuaded to enlarge the petitioner on bail.

Accordingly, the bail application under Section 439 Cr.P.C. is allowed and it is ordered that accused-petitioner Mangla Ram @ Manish S/o Ramniwas arrested in connection with F.I.R. No.38/2017, Police Station Kuchera, District Nagaur, may be released on bail; provided he furnishes a personal bond of Rs.50,000/- with two surety bonds of Rs.25,000/- each to the satisfaction of learned trial Court with the stipulation to appear before that Court on all dates of hearing and as and when called upon to do so.
