Total recovery of 8,600 grams ganja, along with the gunny bag was effected from the accused. After gunny bag was separately weighed, the recovery came to 8,500 grams ganja .

The above finding returned by the ld. trial Court is based on appreciation of the evidence and, thus, the ld. trial Court rightly held the recovery effected from the accused-respondent to be doubtful.
The view formulated by the ld. trial Court on appreciation of the evidence cannot be terms as perverse. Furthermore, the view formulated by the trial Court is one view, which is possible on the facts and circumstance of the case.
Hence, no ground is made out to grant leave to appeal.
Therefore, the present leave to appeal is dismissed.
