Heard learned Public Prosecutor and the learned counsel for the respondents and perused the judgment impugned.

This Court is of the opinion that there are valid and substantial grounds for grant of leave to the applicant for filing an appeal against the acquittal of the respondent vide impugned judgments.

¶40

Accordingly, the applications for grant of leave to appeal are allowed. The memo of leave to appeal be treated as an appeal and it be registered as such.

¶41

The respondent is directed to mark presence and furnish a personal bond in the sum of Rs.30,000/- with a surety each in the like amount to the satisfaction of the Dy. Registrar(Judl.), Rajasthan High Court, Jodhpur within three weeks from today for ensuring his presence in the Court as and when called upon to do so.

List for final disposal at the stage of admission on 10.10.2017.
