Mahendra Singh Vs State and Ors.

Having regard to the entirety of facts and circumstances as available on record and after perusing the impugned judgment, I find sufficient grounds to grant leave to the applicant to file an appeal against the acquittal of the respondents vide impugned judgment dated 20.10.2016 passed by learned Addl. Sessions Judge, Jaisalmer whereby the respondents were acquitted from the charge u/s. 341, 327 and 435/34 IPC while setting aside the judgment passed by learned Judicial Magistrate, Jaisalmer convicting the respondents for the above offences.

Accordingly, the application for leave to appeal is allowed.
