It is stated in the application that the petitioner does not wish to press the prayer No.1 and he seeks to withdraw the petition with regard to prayer No. 2 as well with permission to file a fresh one for placing on record all subsequent facts.
In view of the above, the application is allowed. The petition is dismissed as withdrawn with liberty to file a fresh one, if cause of action survives.
