याची की ओर से यह दाि�डक िविवध यािचका धारा-482 द�ड ्ऺि्वया संिहता के ्ऺावधान� के तहत ्ऺ�तुत कर आलौ�य आदेश िदनांक 08.12.2015, ाम �यायालय, जो िक आपरािधक ्ऺ करण संख्या-941/2011(418/02) म� ्ष सांभरलेक िजला जयपुर ्षारा पािरत िकया गया है, िजसके ्षारा याची की ओर से ्ऺ�तुत आवेदन अ�तगर्त धारा-70(2) द�ड ्ऺि्वया संिहता अ�वीकार िकया गया है, को िनर�त िकये जाने की ्ऺाथर्ना की गयी है।
ा याची ने िनवेदन िकया िक याची राज�थान रा�य पथ िव्षान् अिधव्व पिरवहन िनगम म� वाहन चालक के पद पर काय र ्त है, इसिलए उसके अक्सर बाहर रहने के कारण वह तारीख पेशी पर �यायालय म� उपि�थत नहीं हो सका। अत: उसके िव�्ध जारी �थायी िगर�तारी वार�ट को जमानतीय वार�ट म� पिरवितर्त िकया जावे।
काश उ्व तक� का िवरोध करते हुए िव्षान् लोक अिभयोजक �ी ्ऺ ठाकुिरया ने आलौ�य आदेश को सही बताते हुए यािचका अ�वीकार करने का िनवेदन िकया।
उभय प्ष� के तक� पर िवचार िकया गया।

आलौ�य आदेश के अवलोकन से ्ऺ कट होता है िक याची के िव�्ध लि�बत आपरािधक ्ऺकरण म� वह वषर् 2003 से �यायालय से अनुपि�थत है और उसे मफ�र घोिषत िकया जाकर उसके िव�्ध �थायी िगर�तारी वार�ट जारी िकये हुए ह�। ऐसी पिरि�थितय� म� उसके िव�्ध जारी �थायी िगर�तारी वार�ट को जमानतीय वार�ट म� पिरवितर्त िकये जाने का कोई आधार ्ऺकट नहीं होता है।
तदनुसार याची ्षारा ्ऺ �तुत यह यािचका सारहीन होने से िनर�त की जाती है।उ्व ि�थित म� संलग्न �थगन ्ऺाथर्ना प्ऴ भी िनर�त िकया जाता है।
