Petitioner has filed this petition under Section 438 Code of Criminal Procedure, 1973 seeking anticipatory bail in F.I.R. No. 280/2016 registered at Police Station, Sadar, Bundi, Distt. Bundi for offences under Sections 420 of Indian Penal Code, 1860 & 3, 4 & 5 of Prize Chits and Money Circulation Schemes (Banninng) Act, 1978.
Heard.
Learned counsel for the petitioner has submitted that on the basis of secret information Mukesh Chopdar, Mohammed Mustkeem, Surendar Saini & Manish Kahar were apprehended while selling chit fund tickets. As per the prosecution story, the said persons had named the petitioner and had stated that in fact, the company was being run by the petitioner. It is also the case of the prosecution that some pamphlets were recovered from the accused. However, there was no mentioned in the said pamphlets that the company was being run by the petitioner. Petitioner is ready to join investigation.
Learned state counsel has opposed the petition.
