accused-applicant as well as learned Public Prosecutor and perused the record of the case.

It is stated that accused-applicant has been falsely implicated in this case apart from involving him in the previous cases in continuity. The petitioner thus may be enlarged on bail. He undertakes not to commit same or other offence during the period of bail and would remain present at

the Police Station on the dates directed by this Court, if the bail is granted.

Learned Public Prosecutor has opposed this bail application.

After considering all the facts and circumstances of the case and without expressing any opinion on merits of the case, which may otherwise affect outcome of the trial, I am of the view that accusedapplicant deserves to be enlarged on bail on following undertaking of the accusedapplicant :

(I) That the accusedapplicant shall not commit any offence during the period of bail, otherwise, the order granting bail today shall stand cancelled automatically without reference to this Court.

The information about registration of the case would be sent to this Court also so as to give effect to the order of automatic

cancellation of the bail.

(II)that accused-applicant shall report for attendance at the Police Station

concerned on every 07^th day of January and July of the year from the date of release from Jail, failing which, order granting bail today shall stand cancelled automatically without reference to this Court.

Accordingly, the bail application under Section 439 Cr.P.C. is allowed. It is ordered that the accused-applicant, namely, Kunji Lal Meena S/o Shiv Ram Meena be released on bail on the aforesaid undertaking in FIR No.645/2016 registered at Police Station Jawahar Circle, DistrictJaipur for offence under Section 379 of IPC provided he furnishes a personal bond in the sum of Rs.50,000/- together with one surety in the like amount to the satisfaction of the learned trial Court for his appearance before that Court on all subsequent dates of
