Petitioners have filed this petition under Section 438 Code of Criminal Procedure, 1973 seeking anticipatory bail in F.I.R. No. 101/2016 registered at Police Station, Nangal Rajawatan, Distt. Dausa for offences under Sections 143, 323, 341, 452 & 354 of Indian Penal Code, 1860.

Learned counsel for the petitioner has submits that he may be permitted to withdraw the petition qua petitioner No. 1, 3 & 4. Ordered accordingly.

With regard to petitioner No. 2 Chhajulal, learned counsel for the petitioner has submitted that it is a case of version and cross version and no specific overt Act has been attributed to the petitioner Chhajulal, although, he is named in the FIR.

Keeping in view the fact that no specific overt Act has been attributed to petitioner No. 2 and it is a case of version and cross version, it would be just and expedient to order the release of the petitioner no. 2 on bail.

Accordingly without expressing any opinion on merits of the case, this petition is partly allowed. In the event of arrest petitioner

no. 2 be admitted to bail subject to the satisfaction of the Arresting Officer. Petitioner no. 2 shall join investigation as and when required by the police and shall not leave the country without prior permission of the Court. Petitioner No. 2 shall not tamper with the prosecution evidence.
