The matter comes up on an application (APPLW No.144/16) preferred on behalf of the petitioner company seeking withdrawal of the company application in view of the subsequent event.
It is submitted that after filing of the company application, certain communications/ orders were issued by the Bombay Stock Exchange and National Stock Exchange and consequently the scheme of amalgamation in respect whereof approval is sought, stands amended and therefore, the applicant company may be permitted to withdraw the company application with liberty to file fresh.
The application (APPLW No.144/16) is allowed. The company application is dismissed as withdrawn with the liberty as prayed for.
