On the matter coming up before this Court, the counsel for the parties agree that the preliminary decree dated 12.10.1988 passed by the SDO, Jhunjhunu in Suit No.143/1988 has attained finality and the matter is now presently pending before the SDO, Chirawa for passing of a final decree in terms of the order dated 23.02.1994, passed by the RAA, Sikar Camp Jhunjhunu as upheld by the Board of Revenue, Ajmer vide impugned order dated 10.08.1998. It is therefore prayed that the SDO, Chirawa be directed to dispose of the matter now pending before him by passing of a final decree in terms of the preliminary decree dated 12.10.1988, passed by the SDO, Jhunjhunu in Suit No.143/1988 and the order dated 23.02.1994, passed by the RAA, Sikar Camp Jhunjhunu, in accordance with law and procedure prescribed therefor.
