Learned counsel for the petitioner seeks permission to withdraw the writ application since SBCWP Number 7084/2011, which was dismissed on 6th March, 2012, with liberty reserved to the petitioner to seek recall of the order dated 6th March, 2012, if so advised. Learned counsel submits that an application to recall order dated 6th March, 2012, has been entertained and SBCWP Number 7084/2011 has been restored to its original number.
In view of the above the present writ application which is directed against the same award dated 20th January, 2011 cannot be entertained.
The writ petition is dismissed as withdrawn.
It is made clear that withdrawal of this writ petition will not have any adverse effect to the rights of the petitioner while scrutiny of the impugned award in SBCWP Number 7084/2011, in exercise of writ jurisdiction.
