The present second appeal has been filed by the appellantplaintiff against the judgment & decree dated 17/1/2002 passed by learned District Judge, Sirohi in Civil Appeal No.9/94 , whereby, the judgment & decree dated 5/2/1994 passed by learned Civil Judge, Sirohi in Civil Original Suit No.28/93 (17/92) was affirmed. The suit was filed by the plaintiff for recovery of Rs.44,300/- with interest.
Learned counsel for the appellant-plaintiff submits that the dispute between the parties has been settled by way of compromise between them and he prays for withdrawal of the present second appeal.
Learned counsel for the respondent-defendant does not dispute this position.
Accordingly, the present second appeal of the plaintiff is dismissed as withdrawn. Copy of this order be sent to the parties concerned forthwith.
