This second appeal filed by the plaintiffs is arising out of the judgment and decree dated 05.05.2006 passed by the learned Additional District Judge, Nimbaheda Camp Badi Sadri, District Chittorgarh in Civil Appeal No. 15/2004 “Laxman Singh & Ors. Vs. Narain Singh & Ors.” who allowed the appeal filed by the defendants-Laxman Singh & Ors. and set aside the judgment and decree dated 20.09.2004 passed by the learned Civil Judge (Junior Division), Dungla, District Chittorgarh in Civil

Original Suit No. 15/2004 (11/1990) “Narain Singh & Ors. Vs. Laxman Singh & Ors.” by which, the learned Civil Judge (Junior Division) had decreed the suit filed by the plaintiffsNarain Singh & Anr. seeking declaration, permanent injunction against the defendants in relation to dispute relating to a street (गल�) situated in between the houses of the parties at village Talavada,Tehsil Dungla, District Chittorgarh.

The present second appeal has been filed by the appellants, who were the plaintiffs, against the reversal of the findings of the learned Trial Court by the learned First Appellate Court.

On perusal of the record of the case, it is noticed that the learned Trial Court had decreed the suit filed by the plaintiffs seeking declaration, permanent injunction and order in mandatory form in relation to the dispute of lane (गल�) situated in between the houses of the parties. The learned First Appellate Court had, however, reversed the findings of the learned Trial Court and dismissed the suit, while accepting the appeal filed on behalf of the defendants with the following findings:-

The learned counsel Mr. Suresh Shrimali appearing for the appellants-plaintiffs submitted that the learned First Appellate Court has given the perverse findings while reversing the findings of the learned Trial Court. The learned counsel also submitted that the learned First Appellate Court has proceeded on irrelevant consideration, while dealing with the findings recorded by the learned Trial Court on each of the

issues. Therefore, the learned counsel submitted that the substantial questions of law do arise for consideration by this Court in the present second appeal.

Per contra, the learned counsel Mr. Ratna Ram Ankiya on behalf of Mr. V.N.Kalla appearing for the respondentsdefendants submitted that the present second appeal filed by the appellants-plaintiffs has no force and the same is liable to be dismissed. The learned counsel supported the judgment and decree passed by the learned First Appellate Court, by which, the suit of the plaintiffs had been dismissed.

Having heard the learned counsel for the appellantsplaintiffs-Narain Singh & Ors. and upon perusal of the impugned judgments and decree of the both Courts below, this Court is satisfied that no substantial question of law arises for consideration by this Court in the present second appeal filed by the appellants-plaintiffs-Narain Singh & Ors. In the circumstances of the case, the findings of facts arrived at by the First Appellate Court below, that the learned Trial Court had erred in appreciating and in evaluating the evidence, oral as well as documentary, led before it, and, that the defendants were given the permission for constructing the latrine at the disputed plot of land and they had made such construction in accordance with law and compromise between the parties,

Accordingly and in view of the discussion foregoing, the present second appeal filed by the appellants-plaintiffs-Narain Singh & Ors. is dismissed. No costs. A copy of this order be sent to both the Courts below and the parties concerned forthwith.
