This second appeal filed by the plaintiff is arising out of the judgment and decree dated 12.02.2014 passed by the learned District Judge, Churu in Appeal (Decree) No. 03/2014 “Shrawan Kumar Vs. Government of Rajasthan & Anr.” who dismissed the appeal with costs filed by the present appellant-plaintiff-Shrawan Kumar and affirmed the judgment and decree dated 13.01.2014 passed by the learned Civil Judge (Junior Division), Churu in Civil Original Suit No. 50/2003 “Shrawan Kumar Vs. Government of Rajasthan & Anr.” by which, the learned Civil Judge (Junior

Division) had dismsised the suit filed by the plaintiff Shrawan Kumar seeking declaration, mandatory order/perpetual injunction in relation to the plot of land situated at Churu.

The present second appeal has been filed by the appellant, who was the plaintiff before the learned Trial Court, against the concurrent rejection by the learned two Courts below of his claim regarding a plot of land which was claimed on the ground of adverse possession.

The learned Trial Court, after framing of the relevant issues arising out of the plaint and written statement of the parties and leading of relevant evidence, while dealing with the issues Nos. 5 and 3, in its order dated 13.01.2014 observed as under:-

Being aggrieved by the judgment and decree dated 13.01.2014 passed by the learned Trial Court, the plaintiff – Shrawan Kumar filed the first appeal before the learned First Appellate Court of Additional District Judge, Churu namely, Appeal (Decree) No. 03/2014 which was also dismissed on 12.02.2014 , while affirming the judgment and decree dated 13.01.2014 of the learned Trial Court. Having heard the learned counsel for the appellantplaintiff Shrawan Kumar and upon perusal of the impugned judgments and decree of the both Courts below, this Court is satisfied that no substantial question of law arises for consideration by this Court in the present second appeal filed by the appellant-plaintiff-Shrawan Kumar. In the circumstances

of the case, the findings of facts arrived at by the Courts below, that the plot of land was demarcated and set apart and was handed over by the respondent No.1-State of Rajasthan to the respondent No.2–RIICO, who is supposed to develop the plots of land for use of industrial purposes and the finding against the appellant-plaintiff that he is an encroachee over the plot of land and cannot claim any right on the basis of adverse possession which is considered a very weak plea in view of the decisions in the cases of Maria Margardia Sequeira Fernandes & Ors. Vs. Erasmo Jack De Sequeria reported in (2012) 5 SCC 370 and State of Haryana Vs. Mukesh Kumar & Ors. reported in (2011) 10 SCC 404, cannot be said to be perverse, in any manner, and do not give rise to any substantial question of law in this second appeal and this second appeal of the appellant-plaintiff-Shrawan Kumar deserves to be dismissed being devoid of any merit.

Accordingly and in view of the discussion foregoing, the present second appeal filed by the appellant-plaintiff-Shrawan Kumar S/o Parmeshwar Lal Mali is dismissed. No costs. A copy of this order be sent to the Court below and the parties concerned forthwith.
