Instant petition has been preferred under Section 482 Cr.P.C. by the complainant/petitioner praying interalia that a direction be issued to the respondents to conduct fair, proper, impartial and expeditious investigation in a case arising out of F.I.R. bearing No.285/2011, registered at Police Station Laxmangarh, District Alwar for offence punishable under Section 379 IPC.
The learned Public Prosecutor for the State and Investigating Officer/CO Mr. Suresh Chandra, present in person submit that after investigation I.O. reached on the conclusion that offence u/s 420 and 382 IPC is made out against the accused Jakar S/o Nasiba. They, to allay the apprehension of the complainant/petitioner, at the out set, have submitted that not only fair investigation shall be conducted, but also the report of investigation, along with
the opinion of the Investigating Officer shall be submitted in the Court of competent jurisdiction by the Investigating Officer within a period of two months from the date of receipt of certified copy of this order.
The learned counsel appearing for the complainant/petitioner submitted that the present petition may be disposed of in terms of the statement made by the learned Public Prosecutor for the State.
In view of it, the misc. petition is disposed of in terms of the submissions made by learned Public Prosecutor and Investigating officer.
The stay application also stand disposed of accordingly.
