Heard learned counsel for the accused-applicant as well as the learned Public Prosecutor and perused the record of the case.

Learned counsel submits that third bail application was dismissed on the ground that trial is near completion, however, after keeping the case for final argument, learned Magistrate referred the case to the Sessions Court on finding the offence under Section 9 of the Bovine Animal Act. Looking to the aforesaid, accused-applicant may be enlarged on bail, as the trial is likely to take time because by now, only charges have been framed.

Learned Public Prosecutor has opposed this bail application and submits that accused-applicant is one, who was carrying 59 bovine animals without license and they were kept in such a manner that they may die. Looking to the aforesaid, accusedapplicant may not be enlarged on bail.

After considering the rival submissions made by the learned counsel for the parties and without expressing any opinion on the merits of the case, which may otherwise affect outcome of the trial as well as looking to the facts available on record, I am not inclined to accept this bail application and accordingly, the same is dismissed.

However, the trial Court is directed to expedite the trial and complete it and preferably within a period of four months from the date of receipt of copy of this order, as the accusedapplicant is behind bars for last one year.
