�ाथ� क� ओर से एक �ाथ�नाप� अ�तग�त धारा 5 समयाव�ध अ�ध�नयम ��तुत कर रे�टोरेशन �ाथ�नाप� पेश करने म� हुई देर� को माफ �कये जाने क� �ाथ�ना क� है। मैन� उ� �ाथ�नाप� म� अं�कत त�य� का अवलोकन �कया। म� �ाथ�नाप� म� अं�कत त�य� से संतु� हूं। अत: उ� �ाथ�नाप� �वीकार �कया जाता है एवं रे�टोरेशन �ाथ�नाप� पेश करने म� हुई देर� को माफ �कया जाता है।

�ाथ� क� ओर से इस रे�टोरेशन �ाथ�नाप� के मा�यम से अपील को पुन: मूल न�बर पर रे�टोर �कये जाने क� �ाथ�ना क� गयी है।

मैन� �ाथ�नाप� म� अं�कत त�य� का अवलोकन �कया। म� �ाथ�नाप� म� अं�कत त�य� से संतु� हूं। अत: �ाथ� क� ओर से ��तुत यह रे�टोरेशन �ाथ�नाप� �वीकार �कया जाता है एवं अपील को पुन: मूल न�बर पर रे�टोर �कये जाने का आदेश �दया जाता है।

अपीलाथ� के �व�ान अ�धव�ा क� �ाथ�ना है �क अपील को इस �नद�श के साथ �न�ता�रत कर �दया जावे �क अधीन�थ �यायालय उनके सम� लं�बत �करण का �न�तारण यथासंभव एक वष� क� अव�ध म� करे।

�व�ान अ�धव�ा क� उ� �ाथ�ना �यायसंगत है। अत: अधीन�थ �यायालय को �नद�श �दया जाता है �क वे इस मामले से संबं�धत उनके सम� लं�बत �करण का �न�तारण यथासंभव एक वष� क� अव�ध म� करे।

अपीलाथ� क� ओर से ��तुत अपील का �न�तारण उपरो�ानुसार �कया जाता है। अपील के साथ संल�न �थगन �ाथ�नाप� �नर�त �कया जाता है।
