The learned counsel further submitted that originally, the applicant had challenged by way of filing the aforesaid revision petition, the decree dated 16.09.2006 passed by the Executing Court beyond the scope of the decree dated 25.02.2004 passed by the Rajasthan Non-Governmental Educational Institutions Tribunal, Jaipur in Case No. 146/2001. In the last, the learned counsel submitted that in aforesaid circumstances, this application may kindly be allowed and the order dated 18.08.2011 may be recalled and the matter involved in the aforesaid revision petition (No. 534/2006) may be heard on merits.
