This appeal has been filed against the judgment dated 30.7.2011 passed by Addl. District and Sessions Judge (Fast Track) No.9, Jaipur in Claim Petition No. 54/2009, whereby the claim petition filed by the claimants has been partly allowed and an amount of Rs. 14,99,676/- has been decreed in favour of the claimants.

Brief facts of the case are that on 9.11.2008, the deceased Karunendra Singh was going from Malviya Nagar to Mahesh Nagar by his motor cycle No. RJ 05-2M 5695. At about 11.30 PM when he reached near Gandhi Nagar Railway Station, a Bolero Jeep No. RJ 32UA 0960, which was being driven by the driver rashly and negligently, hit the motor cycle and due to hit of the jeep, the deceased fell down from the motor cycle and sustained serious injuries on his part of the body and succumbed to injuries.

Thereafter FIR was lodged, a claim petition was filed mentioning therein that the deceased was 30 years old person; he was a lawyer and practicing in Rajasthan High Court Jaipur and

earning near about Rs. 20,000/- per month. Notices were issued, reply was filed, issues were framed and after hearing both the parties, the court below passed the aforesaid judgment and award.

Against the said judgment and award, this appeal has been filed by the Insurance Co.

Learned counsel for the appellant has contended that the judgment and award dated 30.7.2011 passed by the Tribunal is illegal and contrary to the provisions of law. He has further contended that the Tribunal while passing the award has not considered the averments made in the written statement by the Insurance Co. He has further contended that the Tribunal has committed error in passing the award ignoring the fact that claimants have violated the conditions of policy and provision of Section 158(6) of the MV Act has not been complied with. The Tribunal has also not considered the other provisions of MV Act. Hence the judgment and award passed by the Tribunal should be quashed and set-aside.

On the other hand, learned counsel for the claimants has contended that deceased was a young and energetic Advocate of the Rajasthan High court and earned more than Rs. 20,000/- per month at the time of accident, having his own family and old aged mother. He was driving the motor cycle no. RJ 05-2M 5695 properly, but the Bolero Jeep, which was being driven by its driver rashly and negligently, hit the motor cycle, as a result of

which the deceased fell down and sustained injuries. He has further contended that the court below, on the basis of material before it, framed the issues and rightly decided the same. Hence, no interference is required by this Court.

I have heard learned counsel for the parties and carefully perused the relevant material on record.

I am in agreement with the observations made by the Tribunal, while passing the impugned judgment and award, the relevant part of which is reproduced as under:

ह�। अत: मTतक क� स�ल�न� आय 1,15,500/-रपय� क� टहस�ब स� उसक� म�मसक आय 9,625/-रपय� म�न� ज�त� ह�। जह�( तक आच^तत� क� आय क� पश ह� चQ(कक मTतक पर च�र प�र!गण आच^त र� जजनम. मTतक क� पत�, मTतक क� द� बचच� व एक मTतक क� म�त� ह� इस पक�र म�न0 नय�नयक द��(नत �? ए स� 2009 (2) प�ज 677 एस स� सरल� वम�'/द�हल? ट�(सप��' क(पन� व अनय म. पनतप�टदत मसद�नत क� अन�स�र च�र प�र!गण ह�न� क� आध�र पर मTतक क� आय स� ¼ क�� ज�कर आच^तत� क� आय ननजaत ककय� ज�न� उचचत पत�त ह�त� ह�। इस पक�र मTतक पर च�र प�र!गण आच^त ह�न� स� यह म�न� ज�त� ह� कक मTतक अपन� आय क� ¼ टहसस� सवय( क� ऊपर खच' करत� ह�ग� तर� ¾ टहसस� प�र!गण क� ल�कर द�त� ह�ग�। अत: आच^तत� क� आय 7219/-रपय� ननजaत क� ज�त� ह�। जह�( तक मTतक क� आय� क� पश ह� उसक� प�नक�ड' पदश'. 20 व र�ज.उचच नय�य�लय ब�र एस�मसएशन क� पररचय पत पदश'. 14 क� अन�स�र मTतक क� जनम त�र?ख 26.4.1974 ह� यह द�र'�न� टद. 9.11.08 क� रट�त ह�य� ह6 इस पक�र द�र'�न� क� समय मTतक 34 वर' क� आय� स� अचधक व 35 वर' क� आय� स� कम क� 34 वर' 6 म�ह 13 टदन क� र�। अत: म��र व�हन अचधननयम क� ध�र� 163 ए क� स�र स(लगन टdत�य अन�सQच� म. बत�य� गय� प�वध�न7 क� अन�स�र मTतक क� 30 वर' स� ऊपर परनत� 35 वर' स� कम आय� क� म�नत� ह�ए कनतपQनत' क� गणन� ह�त� इसम. 17 क� ग�णक लग�य� ज�न� उचचत पत�त ह�त� ह�। अत: इस पकरण म. कनतपQनत' क� गणन� ननमन पक�र स� क� ज�त� ह�:-

7219x12x17=14,72,676/-रपय� बनत� ह6। अत: मTतक यटद ज�षवत रहत� त� उक र�मश प�र!गण क� कम�कर ल�कर द�त�। चQ(कक इस पकरण म. सभ� प�र!गण मTतक क� प�म, पय�र, सन�ह, व�Aसलय व स�व�स�^�र� स� व(चचत ह�ए ह6 अत: इस व(चन� क� मलए पAय�क प�र! क� 5,000/-रपय� क� कनतपQनत' र�मश टदल�य� ज�न� उचचत पत�त ह�त� ह� चQ(कक प�र!गण स(खय� म. च�र ह6 अत: इस मद म. प�र!गण क�ल 20,000/-रपय� क� र�मश प�प करन� क� अचधक�र? ह�। मTतक क� द�ह स(सक�र एव( पररवहन क� मलए 7,000/-रपय� क� र�मश टदल�य� ज�न� उचचत पत�त ह�त� ह�। इस पक�र प�र!गण क�ल 14,99,676/-रपय� क� कनतपQनत' र�मश अप�र!गण स� प�प करन� क� अचधक�र? ह6। श�र कल�म र�मश प�र!गण स�बबत करन� म. असफल रह� ह6 अत: श�र कल�म र�मश असव�क�र क� ज�त� ह�।"

For these reasons, I do not think it just and proper to interfere in the impugned judgment and award passed by the Tribunal and hence, the appeal filed by the Insurance Co. being without any substance is hereby dismissed after confirming the judgment and award passed by the Tribunal.
