Since both these appeals relate to one incident and arise out of the common judgment and award passed by the Tribunal, hence the arguments have been heard together and they are being decided by this common judgment.

Brief facts of the case are that a claim petition was filed by the claimants with regard to death of Jakir Hussain in a road accident, which is said to have taken place on 2.8.2007. Thereafter notices were issued; reply was filed; certain issues were framed and after hearing all the parties, the learned Tribunal passed the aforesaid impugned judgment and award dated 20.2.2014, decreeing an amount of Rs. 10,35,000/- as compensation in favour of claimants.

Being aggrieved by the aforesaid judgment and award passed by the Tribunal, one

appeal has been filed by the Insurance Co. and another appeal has been filed by the claimants for enhancement of compensation.

Learned counsel for the Insurance Co. has contended that the income assessed by the Tribunal is on the higher side. He has further contended that the Tribunal committed error in adding 50% of the income towards future prospects though nothing has come out on record that there was any future prospects of the deceased. Hence, the impugned judgment and award passed by the Tribunal should be quashed and set-aside.

On the other hand, learned counsel for the claimants has contended that the Tribunal has not properly taken into consideration the oral as well as documentary evidence available on record and awarded a very meager amount of compensation. The income of the deceased assessed by the Tribunal is on the lower side. He has further contended that the multiplier applied in this matter is also on the lower side. The Tribunal has also awarded very meager amount under the head of loss of consortium, loss of love and affection and transportation and funeral expenses. Hence, the impugned judgment and award passed by the learned Tribunal deserves to be modified.

I have heard learned counsel for the parties and carefully perused the relevant material on record.

Looking to the facts and circumstances of the case, the Tribunal is found to have dealt with each and every aspect of the matter ad-longum and rightly decided all the issues. I am in agreement with the findings arrived at by the learned Tribunal while passing the impugned judgment and award, the relevant part of which is reproduced as under:

यह ददखत! ह$ई र�9तवरकत� ह� कक र�9तवरक पचल�त मजद�रC दर सरक�र द�र� ननर�&ररत नय�नतम र�तन स� �गभग द�ग$न! रहत! ह�। रर&, 2008 स� अब तक नय�नतम र�तन म5 द�ग$न� स� अधरक क� र�वI ह$ई ह�। अ:�&त म�तक क ज!रन क�� म5 भवरषय म5 ननसLत रप स� आमदन! म5 र�वI ह�न� क�ई क�रC कलपन� नहC4 ह� बसलक ऐस� नहC4 म�नन� र�9तवरकत� स� आ4ख� म�4दन� क� सम�न ह�। अत: उपर�क नय�य दष�4त म� पनतप�ददत वरधरक स9:नत क� अन$स�र म�तक क� उम क� द�खत� ह$ए भ! भवरषय क� आय म5 50 पनतशत क� र�वI म�नत� ह$ए पनतकर क� आ4क�न ककय� ज�न� उधचत एर4 आरशयक ह�।

आधRतत� क� ह�नन क� आ4क�न करन� क� कम म5 म�नन!य सर0चच नय�य��य क� वरनन�&य 2009 ड!0 एन0 ज�0 684-सर�� रम�& बन�म ड!.टC.स!. स� म�ग& दश&न ��न� पर म�तक क� उम क� द�खत� ह$ए 15 क� ग$�क �ग�ग�। म�तक पर उसक� पत!, म�त� र त!न बचच� आधRत रह� हU। अत: आधRतD क� स4खय� क� द�खत� ह$ए उक नय�नयक दष�4त क� र�शन! म5 म�तक क� 9रय4 क� खचW क� ल�ए आमदन! क� ¼ भ�ग क�टत� ह$ए कनतप�नत& क� आ4क�न ककय� ज�न� ह�। तदन$स�र प�:Xग� क� आधRतत� क� ह�नन क� रप म5 क$� 4000 क� 50 पनतशत र�वI क� क� आर�र पर 6000 म�लसक ननर�&ररत कर उसक� ¼ भ�ग कम करन� पर क$� 4500X15X12=8,10,000/-रपय� दद��य� ज�न� उधचत ह�।

In this view of the matter, I do not find any ground to take a different view than that of the view taken by the learned Tribunal. Hence, both the aforesaid appeals filed by the Insurance Co. as well as the appeal filed by the claimants, being without any substance, are hereby dismissed after confirming the judgment and award passed by the Tribunal.

Stay application(s) also stand dismissed accordingly.
