The first application for suspension of sentence was rejected on 29.1.2013 as it was not pressed.
Other than incarceration, there is nothing substantial change in circumstances. However, as regards hearing of the appeal is concerned, the appellant is at liberty to move application for hearing of appeal which is always considered on its priority.
Taking note of the submissions made, but without expressing any opinion on merits, we are not inclined to suspend the sentence awarded to the present accused appellant under the facts & circumstances of the case.
Consequently, the application for suspension of sentence of the present accused appellant stands rejected.
