Contention of learned counsel for the petitioner is that the petitioner’s appointment has wrongly been cancelled by the respondents merely on the ground of pendency of criminal case against him for the offence under Section 376 IPC. It is contended that the petitioner has been acquitted from the charges levelled in that criminal case vide judgment dated 17.12.2013 as the prosecutrix turned hostile.
If that be so, the petitioner is required to approach the Director General of Border Security Force , New Delhi by way of filing representation who may consider the representation of the petitioner in the light of aforesaid facts and decide the same by passing appropriate order addressing the grievance of the petitioner within a period of two weeks from the date of its filing.
