Though this petition has been registered on a communication said to have been sent by the convict Mamta Devi W/o Phoolaji with the prayer that she was serving the sentence at the Open Air Camp, Pratapgarh but was desirous of being shifted to the Open Air Camp at Mandore, Jodhpur.
However, the learned Government Counsel submits after competing his instructions that the concerned prisoner has specifically stated in writing that she was not desirous of being shifted to Open Air Camp, Mandore, Jodhpur and rather she has never made any such application.
The application whereupon this petition came to be registered has been sent per speed post from Post Office Mandore, Jodhupr.
The submissions as made by the petitioner-prisoner before the Superintendent, District Jail Pratapgarh prima facie lead to the position that the petitioner-prisoner is not desirous of being shifted to Open Air Camp Mandore.
Therefore, without going into any other aspects of the matter, we consider it proper to terminate the proceedings in this parole petition but, of course, with liberty for the petitioner-prisoner to move afresh in case of any grievance remaining yet or arise in future.
