This revision petition has been filed by the petitioner against the order dated 22.10.2005 passed by Judge, Family Court, Ajmer in Cr. Case No. 158/2003, whereby Rs. 2000/- has been awarded as maintenance to the respondent-wife and Rs. 1000/has been awarded as maintenance for the son Harshit @ Hani.
I have heard learned counsel for the parties and perused the impugned order dated 22.10.2005.
I am in agreement with the findings arrived at by the Judge, Family Court, Ajmer in her order dated 22.10.2005. The relevant part of the order dated 22.10.2005 reads as under:
"जहाँ तक ूाथ�या क� ः�यम क� आय का स�बंध है ूाथ�या ने अपनी साआय मे बताया है �क वह कोई काम नह� करती तथा उसक� माता ए. ड�लू. 2 तारा गहलोत ने अपने सशपथ बयानो मे कहा है �क उसक� पुऽी म�हने मे एक दो बार युिनविस�ट� मे ले�चर के िलये जाती है तब एक ले�चर के 200/- �पये िमलते है अत: ूािथ�या क� साआय से यह भी ूकट हो�ा है �क ूाथ�या के पास ः�यम व अपने अवयःक पुऽ के भरण पोषण हेतु कोई ःथाई अथवा पया � आय का साधन नह� है| जहाँ तक अूाथ� क� आय का ू � है, ूाथ�या ने अूाथ� �ारा िश�ण संःथान चलाने व क�पयूटर संःथान चलाने के काय� से ू ितमाह 30 हजार �पये आय अ�ज�त
करना बताया है| अूाथ� ने अपने जवाबदावे के पैरा न. 22 मे क�पयूटर ठ�क करने के �यवसाय से 2500-3000 �पये मािसक कमाना तथा इसी पैरा के अंत मे ः�यम को बेरोजगार होना व मजदूर� करके जीवन यापन करना बताया है| अत: अूाथ� जहाँ एक और ः�यम का क��यूटर ठ�क करने का �यवसाय करना ःवीकार करता है, वह� दूसर� ह� सांस मे ः�यम को बेरोजगार बताकर मजदूर� करने का कथन करता है, अूाथ� पढा िलखा युवक है ः�यम ने अपने जवाबदावे के पैरा न. 13 मे िश��त व क�पयूटर �ड�लोमा हो�डर होना ःवीकार �कया है, इस अवःथा मे एक ःवःथ अ� पु� जवान �य�� जो िश��त व क��यूटर �ड�लोमा हो�डर है, उससे यह अपे�ा नह� क� जा सकती �क वह बेरोजगार हो और केवल मजदूर� करके अपना जीवन यापन करता हो, �वशेषकर उन प�र�ःथती मे जबक� वह ः�यम क��यूटर �यवसाय करना ःवीकार करता है| अत: रेकाड� पर आये त�यो से अूाथ� �ारा क��यूटर �यवसाय का काय� करना माने जाने यो�य है और अूाथ� के ःतर के आधार पर अूाथ� क� क�पयूटर �यवसाय से आय औसतन 15000/- �पये होना माने जाने यो�य है|
ाथ�या ने अपने पुऽ का एच. के. जी. मे स�ट ःट�फन ःकूल मे पढना बताया है तथा उसके समथ�न मे उसका फ�स काड�, �कताबो क� रसीद आटो �कराये क� रसीद आ�द पेश क� है �जसके अवलोकन से ू कट होता है �क पुऽ क� पढाई परू ितमाह 610/- �पये फ�स के औटो �कराये के 275/- �पये खचा� आता है तथा इसके अलावा भी उसक� �कताबो खाने पीने व अ�य आवँयकताये है| अत: ूकरण क� समःत प�र�ःथितयो पर �वचार करते हुए इस त�य को देखते हुये �कू
ािथ�या व उसके पुऽ को भी अूाथ� के समान जीवन ःतर से जीवन यापन करने का अिधकार है, अूाथ� क� आय वू ाथ�या व उसके पुऽ क� आवँयकताओ को देखते हुये आज आदेश क� ितथी 22.10.05 से ू ाथ�या पूजा को ः�यम के
िलये 2000/- �पये ूितमाह व उसके पुऽ ह�ष�त उफ� हनी के िलये 1000/- �पये ूितमाह कुल 3000/- �. (तीन हजार �पये) ितमाह भरण पोषण भ�ता अूाथ� से �दलाया जाना उिचतू तीत होता है| अत: उपरो� समःत अिभिनधा�रण �ब�दू इसीू कार ूाथ�या के प� मे िनण�त �कये जाते है| ूाथ�या काू ाथ�नापऽ इसी ूकार ए�प�ीय ःवीकार �कये जाने यो�य है"
In view of above, I do not find any force in this revision petition and the same being bereft of any merit, deserves to be dismissed, which stands dismissed accordingly after confirming the order dated 22.10.2005 passed by the court below.
The stay granted on 14.3.2007 is vacated and stay application stands disposed of accordingly.
