Heard.
Learned counsel for the petitioner has submitted that he could not trace the case listed in the cause list, as such, he could not appear before the court on 27.07.2011. The order was passed in his absence, therefore, he could not comply the order and due to preamptery order the revision petition was dismissed on 19.08.2011. Now petitioner is ready to comply the order and inadvertant of counsel should not be hurdled for imparting the justice. Learned counsel has submitted that application may be allowed and S.B. Criminal Revision no. 2862/2011 be restored.
Considering the facts submitted by learned counsel and the facts mentioned in the application, I deem it appropriate to allow this application which is hereby allowed and S. B. Criminal Revision Petition No. 2862/2011 is restored on its original number. Office to proceed.
