Non-compliance of the order dated 26.09.2011, passed by this Court, has been alleged in this petition. Thereunder this Court had directed that the respondents would be restrained from recovering excess amount, if any, paid to the petitioner as the payment was quite apparently not made on account of misrepresentation or fraud attributable to the petitioner, but owing to an error of the respondents themselves.
A detailed reply to the contempt petition has been filed. It has been submitted that the petitioner superannuated from service on 31.07.2010 and all due amounts have been paid to him without any recovery being made from him as directed by this court. It is therefore prayed that in this view of the matter, the contempt petition be dismissed.
For reasons detailed in the reply to the contempt petition, it is manifest that order of this Court passed on 26.09.2011 has not been contravened. There is no force in the contempt petition.
Dismissed. Notices discharged.
