Non-compliance of the order dated

23.3.2009 passed by this Court is alleged in

this petition whereby the petitioner's
reversion from the post of LDC to Class IV was
quashed by this Court.

Reply to the contempt petition has
been filed. It has been submitted that vide
order dated 1.7.2010 the petitioner was
reinstated on the post of LDC subject to the
outcome of DB Civil Special Appeal filed by
the State against the order dated 23.3.2009.
However, following the dismissal of the DB
Civil Special Appeal on 11.3.2011, vide order
dated 7.12.2011 the earlier order of the
petitioner's reinstatement on the post of LDC
passed on 1.7.2010 was modified and the words
“subject to the final outcome of the DB Civil

Special Appeal” were deleted. It has been
submitted that the order dated 23.3.2009 thus
stands fully complied with and no contempt of
the order aforesaid, as alleged, can be
remotely made out.

In the facts obtaining, the contempt
petition deserves dismissal. Accordingly
dismissed. Notices issued to the respondents
stand discharged.
