The learned Single Judge vide impugned judgment and order dated 2nd of April, 2013 disposed off a bunch of writ applications, including one preferred by the petitioner-appellant, determining the issue of granting Experience Certificate with reference to the candidates, who are working or worked on the posts of Junior Technical Assistant (JTA), Junior Engineer, Gram Rozgar Sahayak, Data Entry Operator, Computer Operator with Machine, Lekha Sahayak, Lower Division Clerk, Coordinator IEC, Coordinator Training, Coordinator Supervision other than through placement agency in MGNREGA or under any scheme of the Department of Rural Development and Panchayati Raj, were only entitled to an Experience Certificate to claim bonus marks. It has been further observed that in the light of the statutory provisions, neither the petitioner(s) can claim inclusion of post or scheme not given therein nor the Department can do it without further amendment. The learned Single Judge concluded that a candidate working/ worked on the post(s) as detailed out in the amended Rules and otherwise working/ worked under MGNREGA or any of the schemes of the Department, would only be entitled for Experience Certificate. However, liberty was granted to challenge the validity of the Rules, if so advised.
