has to be in consonance to rule 273 of the Rules of 1996 and as amended vide Notification dated 29.01.2013. If the rules quoted in preceding paras are looked into, length of experience exceeding one year would be allowed to those, who were engaged on the post of Junior Technical Assistant (JTA), Junior Engineer, Gram Rozgar Sahayak, Data Entry Operator, Computer Operator with Machine, Lekha Sahayak, Lower Division Clerk, Co-ordinator IEC, Coordinator Training, Co-ordinator Supervision other than through placement agency in MGNREGA or under any scheme of the Department of Rural Development and Panchayati Raj. In the light of the statutory provisions, neither the petitioners can claim inclusion of post or scheme not given therein nor the Department can do it without further amendment. Thus Court should not issue direction contrary to the rules and, at the same time, the Government has no authority to issue circular or advertisement in violation of rules. Accordingly, experience certificate can be claimed and may be given to those, who are working on any of the posts mentioned in the amended rules vide Notification dated 29.01.2013 and, that too, under MNREGA or any other schemes of the Department.
