Heard learned counsel for the petitioner and the PP.

This misc. petition has been filed against the order dated 20.4.1999 of the Addl. Chief Judicial Magistrate Bundi in Cr. Case No. 72/99 whereby cognizance has been taken againstthe petitioners for the offence under sections 108, 120 B, 188 and 223 IPC.

I have gone through the order passed by the ACJM taking cognizance the petitioners for the offence under sections 108, 120 B, 188 and 223 iPC. The order was passed in the year 1999 and only the record of the case was called in the year 2001 and the same was sent back in the year 2005. During this period the trial court must have almost completed the trial. In these circumstances, in my view the order passed in the year 1999 taking cognizance against the petitioner does not call for any interference by this court in the year 2012. The criminal misc. petition stands dismissed. However, the petitioners shall be at liberty to raise all the points raised in this misc. petition before the trial court if the trial has not been completed at the time of final hearing of the case. The stay application also stands dismissed.
