This petition has been filed under Section 482 of CrPC for quashing of First Information Report No. 126/2012 lodged at Police Station, Bonli, District Sawai Madhopur for the offence punishable under Section 3(x) of Scheduled Caste / Scheduled Tribe (Prevention of Atrocities) Act, 1989.

Mr. Ramakant Gouttam petitioner is present in person in this Court. He has contended that this is false First Information Report, which has been lodged by the complainant against him and other accused persons.

Upon this, we have called the Investigating Officer Mr. Deshraj Yadav, CO (Rural), Sawai Madhopur, who is present in person along-with the case diary. He has made the statement in the Court that he has submitted the Final Report in FIR No. 126/2012 before the Superintendent of Police, Sawai

Madhopur.

In view of the above statement made by Mr. Deshraj Yadav, Circle Officer, Sawai Madhopur, the instant criminal misc. petition has become infructuous and the same is hereby dismissed as having become infructuous. However, liberty is granted to the petitioner that if any new fact arises, he can move the petition under Section 482 of CrPC afresh.

Consequent upon the dismissal of criminal misc. petition, the stay application, filed herewith, does not survive and the same also stands dismissed.
