अपीलाथ� की ओर से यह िसिवल िविवध अपील अपर िजला न्यायाधीश (फास्ट �ेक) �म संख्या 6, जयपुर नगर �ारा पािरत िनणर्य िदनांक 16.11.2007 के िवरु� �स्तुत की गयी है, िजसके �ारा अपीलाथ�-क्लेमेन्ट को 47,200/- रुपये ्षितपू�त रािश िदलाये जाने का आदेश िदया गया।
अपीलाथ� के िव�ान अिधव�ा ने इस �करण के त�य� म� जाने से पूवर् कथन िकया िक िव�ान अिधकरण ने िववाघक संख्या 4 का िनणर्य सही रुप से नह� िकया है, िजससे मामले को अिधकरण को पुन: िनणर्य पािरत करने के िनद�श के साथ वािपस भेजा जावे।
इस पर �त्यथ� संख्या 2 के िव�ान अिधव�ा का कथन है िक यिद �करण को अिधकरण को पुन: िनणर्य हेतु वािपस भेजा जाता है तो उनके �ारा अिधकरण के सम्ष �स्तुत िकये जाने वाले िविध दृ�ान्त� पर भी गौर पर िनणर्य पािरत करने के िनद�श अिधकरण को िदये जाव�।
उभयप्ष के िव�ान अिधव�ागण को सुनने एवं अपीलाधीन िनणर्य का �यानपूवर्क अवलोकन करने के उपरान्त अपीलाधीन िनणर्य िदनांक 16.11.2007 को

िववाघक संख्या 4 की सीमा तक अपास्त करते हुए मामला अिधकरण को पुन: िनणर्य हेतु भेजा जाकर उन्ह� िनद�श िदया जाता है िक वे प्षकारान �ारा उनके सम्ष �स्तुत िकये जाने वाले न्याियक िविन�य�, यिद वे मामले म� लागू होते ह� तो उनके �काश म� िववाघक संख्या 4 के सम्बन्ध म� अपना िनणर्य सभी प्षकार� को सुनवाई का अवसर �दान करते हुए पुन: पािरत करते हुए मामले का शी� िनस्तारण करे। क्लेमेन्ट को पंचाट की सम्पूणर् रािश या आंिशक रािश �ा� हो गयी हो तो अिधकरण के िनणर्य तक उनसे उ� रािश की वसूली नह� की जावे। प्षकारान अिधकरण के सम्ष िदनांक 18.2.2013 को उपिस्थत ह�।
अपीलाथ� की ओर से �स्तुत इस अपील का िनस्तारण उपरो�ानुसार िकया जाता है।
