The petitioner-accused Nand Ram has moved this third bail application after recording of the statements of few more witnesses in the trial.

Though this Court would not be making comments on the merits of the case but for the present purpose, suffice is to observe that after having heard the learned counsel for the petitioner and learned Public Prosecutor and having taken into comprehension the case as a whole on the facts and factors as narrated by the witnesses about the events of the past leading to the dispute about the possession of the land in question wherein the petitioner has been named as the prime and pivotal person qua the dispute and in the incident, this Court is not persuaded to grant indulgence to the petitioner. This third bail application is, therefore, required to be dismissed.

However, the petitioner is said to be about 70 years of age and is in custody since 30.06.2009. It is definitely expected of the learned Trial Court that the matter is proceeded with expedition and brought to finality at the earliest. It is informed that about 16 of the listed witnesses have already been examined and the matter is now fixed in the Trial Court for further evidence on 1^st and 2^nd December 2011. It shall definitely be expected of the prosecution also to co-operate with the learned Trial Court in expeditious proceedings of the matter and to produce the relevant witnesses on the give date; and at the same time it shall be expected of the learned Trial Court to curb against unnecessary delay and to take all the steps for procuring presence of the witnesses and to conclude the trial while assigning this matter a specific priority.

With the observations aforesaid, the third bail application stands dismissed at this stage.
