Petitioner is presently posted in district
Rajsamand. He has assailed the order Anx. 6 dt.
31/07/2008 issued from the District Rajsamand.
The cause of action accrued to the petitioner
for filing the instant writ petition in District
Rajsamand which falls in the jurisdiction of
main seat Jodhpur.

Counsel submits that the petitioner resides
in Dholpur and, as such, writ petition can be
filed before the Bench at Jaipur as well.

In the opinion of this Court, the place
where the petitioner resides is immaterial. So
far assailing of the order is concerned, since
he is serving in Rajasamand and the order has
also been issued from Rajsamand, in the
considered opinion of this Court, the
jurisdiction of the petition lies before the
main seat at Jodhpur.

Consequently, the writ petition is
dismissed. However, the petitioner is at liberty
to file writ petition before the main seat at
Jodhpur, if advised.
