This petition has been field with the grievance that in the order dated 9.2.2007 this court directed to release the vehicle to the petitioner Man Mohan Singh on fulfillment of certain conditions as contained in the said order and further Shri Man Mohan Singh was required to comply with condition as contained in the order but the petitioner Man Mohan Singh has failed to comply with the same after securing the possession of the vehicle.
In the facts and circumstances the applicant Shaukat Ali is permitted to move an application before the learned court below pointing out the breach of the conditions on which the learned court below would issue notices to the petitioner Man Mohan Singh in case after hearing the parties and considering the reply and other material the learned court below comes to the conclusion that any condition has been breached it would be open the court below to
repossess the vehicle and also forfeit the amount of Rs.5 lacs from the surety.
With the aforesaid observations this petition is disposed of.
