[1] The petiti o ner-wife, by way of present ap p lication, seeks transfer of cas e bearing No. G W -27-2025, titled “ Baljinder Singh Vs. Rajwinder Kaur and Anr. ”, filed unde r Section 25 of Guardians and W ards Act, 1890 at the instanc e of respondent-husband; from the Court of le a rned Principal Judge, Famil y Court, Tarn Tara n to the Court of learned Princi p al Judge, Family Court, Zira. [2] Briefly sta t ing, the marriage between the petitioner and respondent wa s solemnized in t he year 2014; out of their w edlock, two children namely, Khushpreet Ka u r, aged 11 years and Guravt a r Singh, aged 10 years, wer e born; on account of matrimonial discord be t ween the parties, the abov e mentioned petit i on came to be preferred a t the instance of respondent - husband. There a fter, the present application seeking its transfer came to b e filed by the petiti o ner-wife. [3] A perusal of the paper-book reveals that the petitioner-wife has filed tw o separate petitio n s under Section 12 of Prote c tion of Women from Domesti c Violence Act be a ring No. COMA/22/2025 and Section 13 of Hindu Marriag e Act for dissoluti o n of marriage bearing No.DM C -106-2025 before the Court o f learned Principal Judge, Family Court, Zira and in both the cases, notices hav e

Moreover, the petitioner-wife is unemployed and does not have any source of independent income. Accordingly, a prayer is made for transfer of the above mentioned petition filed at the instance of respondent-husband from Family Court, Tarn Taran to Family Court, Zira.

[4] On the other hand, learned counsel for the respondent vehemently opposes the prayer made on behalf of the petitioner.

[5] I have heard learned counsel for the respondent and gone through the paper-book.

[6] In the present case, admittedly, the petitioner-wife has filed the following two petitions which are pending adjudication before the Court of learned Principal Judge, Family Court, Zira:-

(1) Section 12 of Protection of Women from Domestic Violence Act bearing No. COMA/22/2025

(2) Section 13 of Hindu Marriage Act for dissolution of marriage bearing No.DMC-106-2025.

[7] As per the averments made in the present transfer application, the distance between Zira and Tarn Taran is approximately 55 kilometres and the petitioner-wife having no source of independent income would undergo huge inconvenience especially, when her minor daughter namely Khushpreet Kaur, aged 11 years has to accompany her.

[8] Furthermore, the Hon’ble Supreme Court in its decision rendered in “ Manjula Singh Chouhan Versus Vishal singh Chouhan”, reported as 2019 (13) SCC 660 held that, in the interest of both the parties, all connected matrimonial proceedings should ordinarily be heard by the same Court and, accordingly, allowed the transfer application therein.

[9] Considering the aforesaid facts and circumstances, in the humble opinion of this Court, it would be in the interest of both the parties that all their cases be heard together by the same Court. Consequently the transfer application is allowed and the petition under Section 25 of the Guardians and Wards Act, 1890 i.e. GW/27/2025 , titled “Baljinder Singh Vs. Rajwinder Kaur and Anr. ”, filed by the respondent-husband, stands transferred from the Family Court, Tarn Taran to the Court of competent jurisdiction at Family Court, Zira. The requisite record of the aforesaid case be sent by the Family Court, Tarn Taran to the Court concerned.

[10] Pending miscellaneous application(s), if any, shall also stand disposed of.
