1 . On the last date of hearing, none had appeared on behalf of the parties and, as such, notices were issued to the parties for today. Today, as per the report of the Registry, the appellant has expired. There is no representation on behalf of the appellant even today. Further, the notices issued to respondents No. 1(a) to 1(c) have been received back duly served, whereas the notices issued to respondents No. 2 to 5 have been received back with the report that they have also expired.
2 . It appears that the parties are not interested in pursuing the appeal.
3 . In view of the above, this Court is left with no other option but to dismiss the appeal for non-prosecution.
