By way of present application filed under Order XXII Rule 4 CPC, applicant/appellant seeks impleadment of LRs of deceased/respondent No.1 Mohan Singh, who is stated to have died during the pendency of the appeal.
As per the averments made in the application, there is no other surviving legal heir left by deceased/respondent No.1 Mohan Singh, except those mentioned in Para No.3 of the application. Death certificate of the deceased/respondent No.1 has been placed on record as Annexure A-1. Application is supported by affidavit.
In view of above, the instant application is allowed subject to all just exceptions. Legal heirs of the deceased/respondent No.1 as detailed out in Para No.3 of the application, are ordered to be impleaded. Amended memo of parties is taken on record.
