Appellant/plaintiffs are in second appeal against the concurrent judgments and decrees render e d by both the District Courts whereby t h eir suit for declaration with co n sequential relief of permanent injunction w as dismissed. 2. The present second appeal is of the year 2017 and has been re-filed with a delay of 532 days (CM-4 3 79-C-2017); and notice in the said appli c ation was issued by the Prede c essor Bench vide order dated 12.10.201 8 . However, notice in the ma i n second appeal is yet to be issued. Pe r usal of the case file reveals tha t after issuance of notice in the aforesaid a pplication for condonation o f delay, the matter has been repeatedly adjourned most of the times at t he oral/written request(s) or on account o f non-appearance or due to cha n ge of counsel on 28.05.2019, 29.08.201 9 , 03.03.2023, 16.05.2023, 21.11.2023, 13.03.2024 and 20.08.202 5 .

Today again, none has put i n appearance on behalf of the appellants, despite the case having been ca l led twice.

A bare reading of the above facts shows that the appellants have exhi b ited an utterly casual attitude in their pursuit of the present litigation. I t is to be appreciated that ve r y valuable public time of the Court has been expended in affording op p ortunities to the appellants in the interes t of justice. On the other hand, the appellants have adopted an utterly cas u al and careless approach. It is clear that neither the appellants nor their counsel are seriously interested in pursuing the present matter. Thus, this C ourt is left with no other optio n except to dismiss the same for non-prose c ution.
