The appellant-defendant is in second appeal against the judgment o f reversal dated 30.09.2013 p a ssed by the learned Additional District Ju d ge, Moga whereby the appeal f iled by the plaintiff/respondent was allow e d, setting aside the judgment and decree dated 18.09.2012 passed b y the learned trial Court; a n d suit for declaration with consequen t ial relief of permanent injuncti o n was allowed. 2. At the very outset, learne d counsel for the appellant(s) submits t h at the question of law involv e d in the present appeal as to whether ju r isdiction of the Civil Court is b arred in view of Section 145 of the Electri c ity Act, 2003, has since been d e cided by the Hon’ble Division Bench of t his Court in RSA-4181-2016 , titled as ‘Mahesh Kumar vs. Sub Divisional Officer and Another’ vid e judgment dated 14.05.2025.

In view of the above, the pr e sent second appeal is allowed, and the s u it filed by the respondent-pla i ntiff stands dismissed on the ground of jurisdiction. However, the res p ondent-plaintiff is at liberty to
