Trial Court (31.07.1980) declined specific performance but awarded Rs. 4,000/- double earnest; redemption suit (05.09.1981) decreed on payment of Rs. 5,000/-; first appellate courts split (specific performance granted 13.05.1983; redemption affirmed 03.12.1983). Held: prior-in-time agreement prevails absent fraud/illegality (Zorawar Singh applied); no finding that Ex.D1 was forged; no reliable evidence of vendees' notice of Ex.P1 — same-village presumption speculative; vendees protected as bona fide purchasers for value under S.19(b), Specific Relief Act, 1963; suit for specific performance unsustainable without a declaration of the non-binding nature of the prior registered sale deed; sale deed not executed in haste (>4 months, full consideration); adverse inference under S.114 illustration (g), Evidence Act 1872, from vendor's non-examination; plaintiff's conduct, collusion and unclean hands bar discretionary relief; appellate findings perverse.
