Section 18 of t h e Land Acquisition Act, 189 4 (for short ‘the 1894 Act’) at the instance of the appellants/landowners was p a rtly allowed while granting t h em benefit of enh a nced compensation at unifor m rate of Rs.42,50,000/- per a cre besides awardi n g all other statutory benefits/i n terest as provided under the 1 8 94 Act.

Le a rned counsel for the parties a re ad idem that the matter w ith respect to the d e termination of market value st a nds adjudicated upon by this C o urt vide its decisi o n dated 18.05.2026 passed in RFA No.387 of 2020 title d as “Yadwinder Singh (Since Deceased) through LRs and Ors Vs. State of Punjab and Ors. ” whereby t he similarly situated landowner s pertaining to the same acquisi t ion proceedings ha v e been held entitled for the e nhanced amount of compensa t ion @ Rs.48,00,00 0 /- per acre, along with all othe r statutory benefits of the amen d ed 1894 Act. Rele v ant para Nos.15 and 16 from the aforementioned judgment are extracted hereu n der:-

“[ 1 5]. Accordingly, the m a rket value for the land u n der ac q uisition is assessed @ Rs. 48,00,000/- per acre as on the dat e of no t ification under Section 4 o f the 1894 Act. In addition, the la nd owners shall also be entitled for award of all statutory ben e fits an d interest as provided under the provisions of the 1894 A ct (a m ended upto date). The land o wners shall also be entitled for so la tium besides award of interest t hereupon. [1 6 ]. Consequently, in v iew of the discussion m ade he r einabove, the appeal(s) p referred at the instance of ap p ellant(s)/landowner(s) are her eb y partly allowed in the afore s aid ter m s and the appeal(s) filed b y the respondent/Punjab Marke t ing B oa rd are hereby dismissed.”

In v iew of the stand taken by both the sides on facts and applying the principle of par i ty and for grant of just and fair c ompensation, the present appe a l is disposed of in t e rms of the aforementioned decision i.e. “Yadwinder Singh (Since Deceased) through LRs and Ors’ case (supra) and the appellants/landowners are held entitled fo r similar amount of market valu e @ Rs.48,00,000/- per acre, as has
