As common issues are involved in the captioned appeals, with the consent of both sides, the same are hereby disposed of by this common order. For the sake of brevity and convenience, facts are borrowed from RFA No.1769 of 1994 .

The appellants through instant appeal are seeking modification of award dated 17.11.1993 whereby learned Additional District Judge, Hoshiarpur has not awarded compensation as claimed by them.

The dispute is confined to compensation with respect to superstructure and trees planted on the acquired land. The Reference Court has awarded compensation qua trees namely Safeda , Mango, Khatti and Mulberry @ ₹30/-, ₹70/-, ₹25/- and ₹10/- respectively. The Court has further awarded compensation of ₹20,000/- towards structure.

Learned counsel for the appellants submits that landowner submitted evidence with respect to value/costs of structure and respondentState did not lead any evidence still Reference Court has determined meager amount of ₹20,000/-. As per report of Technical Expert, it should be ₹73,000/-, thus, appellants are entitled to additional amount of ₹53,000/-.

Learned counsel for respondent-State submits that State has no objection if additional compensation of ₹50,000/- is awarded towards full and final settlement.

In the wake of statement of both sides, the appeal and cross objection stand disposed of with a direction to respondent-State to pay compensation of ₹50,000/- along with ₹75,000/- towards statutory benefits and interest. The appellants shall furnish their bank account details to jurisdictional Sub-Divisional Magistrate who shall ensure release of the aforesaid amount within two months from the date of furnishing of such details.
