Relief belongs to the vigilant claimant; a fence-sitter cannot claim the same relief once delay has occurred. The initial 2014 select list ousted the appellants from the zone of merit and they raised no grievance then; they approached the Court only after similarly situated candidates had been granted relief, hence they are fence-sitters who cannot now barge in to oust candidates selected and working for the last 12 years. The Supreme Court's decision in Chairman/MD, U.P. Power Corporation Ltd. v. Ram Gopal (2021 Vol. 13 SCC 225) is fully applicable.
