On 15.01.2026, this Court, t a king note of the submission made by learned counsel for the appella n ts that the matter had earlier been ref e rred to the Daily Lok Adal a t and that the respondentInsuranc e Company had offered a su m of Rs.3,00,000/- over and above th e awarded amount, referred the m atter to the Permanent Lok Adalat fo r exploring the possibility of an amicable settlement between the parties. Pursuant thereto, the matt e r was taken up before the learned D aily Lok Adalat on 22.01.2026, where, on the basis of statemen t s made by the representatives o f the Insurance Company and learned c o unsel for the appellants, an am i cable settlement was arrived at betwe e n the parties. As per the said set t lement, an additional sum of Rs.3,00,000/- (Rupees Three Lakh o n ly), over and above the compens a tion already awarded by the learned Tribunal, has been agreed to be paid to the appellants in fu l l and final settlement of the claim in t he present appeal. It was furth e r recorded that the enhanced amount s h all be payable to appellant No. 1 -Mamta.

The learned Daily Lok Ad a lat, while disposing of the matter, d irected the respondent-Insura n ce Company to deposit a crossed cheque in the sum of Rs.3,00,0 0 0/- in the name of appellant No.1-Ma m ta with the office of the Lo k Adalat of this Court on or before 1 2 .03.2026, failing which the sai d amount shall carry interest @ 9% p e r annum from the date of th e order till its deposit. The applicati o n seeking condonation of del a y of 39 days in filing the appeal w as also disposed of in view o f the settlement arrived at between t he parties.

same. T h e settlement appears to be law f ul, voluntary and arrived at with the c onsent of the parties, and thus d eserves to be given effect to. Accordingly, the present ap p eal is disposed of in terms of the set t lement dated 22.01.2026 arrived at before the learned Daily Lok Ad a lat. The Award dated 19.09. 2 024 passed by the learned Motor A c cident Claims Tribunal, Sonip a t, shall stand modified to the extent t h at the appellants shall be entitled to an enhanced compens a tion of Rs.3,00,000/- (Rupees Three Lakh only), over and above th e amount already awarded. The said enhanced amount shall be payab l e to appellant No.1-Mamta, in t e rms of the settlement.
