[1] Claimants are in appeal see k ing enhancement of compensa t ion awarded b y the Commissioner under th e Workmen’s Compensation A ct, 1923.

[2] There is no dispute with r espect to the employment of the deceased or his death in an accident arisi n g out of and during the cours e of employm e nt. The only issues raised are: -

(i) Calculation of compe n sation.

(ii) Denial of penalty and interest.

[3] After hearing counsel for th e appellants and carefully peru s ing the recor d of the case, this Court finds th a t the compensation awarded by the

“4. Amount of compensation.-( 1) Subject to the provisions of this Act, the amount of compensation shall be as follow s , namely:-

(a) where death results an amount equal to [fifty p e r from the injury cent.] of the monthly wages of the deceased workma n multiplied by the relevant facto r ; or an amount of [fifty thousan d rupees], whichever is more; (b) where permanent an amount equal to [sixty p e r total disablement cent] of the monthly wages of results from the the injured workman multiplie d injury by the relevant factor;

Explanation I .- For the purpo s es of Cl. (a) and Cl. (b), “releva n t factor”, in relation to a workm a n means the factor specified in the second column of Schedule IV a gainst the entry in the first colum n of that Schedule specifying t h e number of years which are the same as the completed years o f the age of the workman on his la s t birthday immediately prece d ing the date on which the compensation fell due;

Explanation II .- Where the m o nthly wages of a workman excee d [two thousand rupees], his m onthly wages for the purposes of Clause (a) and clause (b) sh a ll be deemed to be [two thousan d rupees] only,

[5] Thus, the compensation wi l l be 146.20 x 1000 x 40 / 10 0 = ₹ 58,480/-. The same is rounded off to ₹ 59,000/-. In terms of Section 4 A, claimants are also entitled for penalty, w hich will be 50% of the awar d ed compens a tion.

[6] With the aforesaid modificat i on, the appeal is disposed off. [7] All pending miscellaneous application(s), if any, stand s disposed o ff .
