Appeal by Anzali @ Anjali and others versus Parvesh Kumar and others. CM-2600-CII-2026 has been filed for bringing on record the legal representatives of Karambir, appellant No.4.

The application is supported by an affidavit of Suman Devi, wife of the deceased, as well as the copy of the death certificate (Annexure A-1).

Keeping in view the averments made in the application, the widow and daughters of the deceased, as detailed in paragraph No.4 of the application, are hereby impleaded as legal representatives of the deceased, only for the purpose of pursuing the main appeal.

Amended memo of parties filed, which is taken on record. Accordingly, the application stands disposed of.

Perusal of the paperbook reveals that in the pre Lok Adalat, the compromise had already been effected between the parties, for an amount of Rs.5,75,000/-. However, the same could not be fructified, on account of death of appellant No.4 and his legal representatives were to be impleaded.

Since, the needful has been done and also as per disclosure made by both the counsel, in the order dated 23.12.2025, the Insurance Company, is hereby directed to pay the requisite amount, as settled, within a period of 45 days from today onwards.

In the eventuality of any default, on the part of the Insurance Company, in making the payment, within the requisite period, it shall be liable to pay the penal interest of at the rate of 8%, till realization.

Accordingly, the appeal stands disposed of.
