Common order of the High Court of Punjab & Haryana (Nidhi Gupta, J.), 27.01.2026, disposing of cross-appeals arising from a tractor-trolley accident of 28.12.2016 and the Award dated 13.03.2019 of the Motor Accident Claims Tribunal, Sangrur in MACT Case No.24 dated 28.08.2017 (S.166, Motor Vehicles Act), which awarded the injured-claimant Hardeep Singh Rs.6,39,824/-. (1) CM-6497-CII-2020: condonation of 247 days' delay in filing FAO-2318-2020 refused — the averments were vague and general and did not constitute sufficient cause for the inordinate and extraordinary delay; application dismissed. (2) FAO-2318-2020 (claimant's enhancement appeal): dismissed on grounds of delay as well as merits. Functional disability of an injured-claimant is to be assessed on the basis of the impediment caused to him in discharging his pre-accident activities (U.P. Road Transport Corporation v. Vibhor Fialok, SC). The claimant's pleaded employment in a Kiryana Shop stood unproved; his Income Tax Returns (Ex.C-42 to Ex.C-44, Business Category) proved he ran a small-scale business, on whose average (Rs.1,59,066/- per annum) and his age (33 years) the Tribunal added 25% future prospects relying on the Constitution Bench judgment in National Insurance Company Ltd. v. Pranay Sethi, applied multiplier 16, and assessed functional disability at 15% — 'no error' found; counsel showed no medical evidence of difficulty in the discharge of the claimant's business functions. (3) FAO-5243-2019 (insurer's appeal seeking setting aside of the Award and dismissal of the Claim Petition): dismissed — the 8-day delay in registration of the FIR (accident 28.12.2016; FIR No.3 on 05.01.2017) is explained by the claimant's immediate hospitalization, and the one-digit difference in the offending vehicle's registration number (RJ-31-RA-7328 in FIR/Claim Petition versus RJ-31-RA-7238 in the challan) is not fatal and does not disprove its involvement.
