By way of this common order, aforementioned two writ

petitions are being disposed of. The facts are being culled out from CWP-7264 of 2026 – Gurvinder Singh and others v. State of Punjab and

others.

Prayer in CWP-7264 of 2026 is for quashing the order dated 04.02.2026 (Annexure P-4), whereby claim of the petitioner is kept in abeyance till the State Government takes a final decision with regard to grant instalments of DA/DR; to direct the respondents to grant the benefit of dearness allowance/dearness relief to the employees retired furing the period from January, 2020 to June, 2021 @ 21% w.e.f. 01.01.2020, @ 24% w.e.f. 01.07.2020, @ 28% w.e.f. 01.01.2021 in accordance with the instalments granted to the Central Government Employees vide office memorandum dated 07.09.2021 (Annexure P-2) for the calculation of Gratuity and Leave Encashment on the basis of All India Consumer Price Index and to grant DA/DR and arrear of revised gratuity and leave encashment in view of revised DA at par with Government of India pattern along with interest @ 12% per annum on the delayed payment of arrears.

On the last date of hearing i.e. 07.07.2026, the following order was passed: -

“Learned State counsel has produced a copy of the notification dated 06.07.2026, issued by the Government of Punjab, Department of Finance (Finance Pension Policy and Coordination Branch), showing the calculation of gratuity and cash payment in lieu of leave regarding State Government employees retired during the period from January, 2020 to June, 2021. The same is taken on record and reads as under: -

“3. In view of the provisions of the aforesaid letters, calculation of Graguity and cash payment in lieu of leave in respect of State Government employees who retired on or after 01.01.2020 and up to 30.06.2021 are required to be made based on the rate of DA at 17% of basic pay.

Keeping in view that gratuity and cash payment in lieu of leave are one-time retirement benefits admissible to employees on retirement and employees who retired during the period from 01.01.2020 to 30.06.2021 have been allowed lesser amount than what would have been calculated but for the aforesaid notification, the matter has been considered sympathetically with a view to allowing the same to such employees.

5. Accordingly, it is conveyed that in respect of State Government employees who retired on or after 01.01.2020 and up to 30.06.2021, the amount of DA to be taken into account for calculation of Gratuity and cash payment in lieu of leave will be deemed to be

6. All other conditions as stipulated in Punjab Civil Services Rule and instruction issued from time to time in respect of State Government employees shall continue to be applicable while calculating gratuity and cash payment in lieu of leave respectively.

7. All the Pension Sanctioning Authorities be directed to clear the benefits within a period of 3 months from the issuance of the instructions as per rules.”

Learned counsel for respondent No.3 in CWP7264 of 2026 and for respondent No.4 in CWP-8200 of 2026 seek time to get instructions with regard to the release of necessary payments to the petitioners and other similarly situated persons.

Mr. Anupam Singla, learned counsel for respondent No.3 in CWP-7264 of 2026 has produced a copy of the order dated 13.07.2026, issued by the Pepsu Road Transport Corporation, Patiala, whereby instructions No.FD-FPPCOMISC/230/2022-3FPPC-Part(1)I/1439014/2026 dated 06.07.2026 issued by the Finance Pension Policy and Coordination Branch have been accepted in toto and has also been implemented. The same is taken on record. He submits that the necessary payments arising out of the said notification shall be released to the petitioners as well as similarly situated persons in terms of the RAVINDER SINGH said policy, within a period of three months from today. 2026.07.14 18:55 I attest to the accuracy and authenticity of this order/judgment

Further, Mr. Rehat Bir Singh Mann, learned counsel for respondent No.4 in CWP-8200 of 2026 submits that necessary payments arising out of the said notification dated 06.07.2026 shall be released to the petitioners as well as similarly situated persons within a period of three months in terms of the said policy.

In view of the above statements, learned counsel for the petitioner(s) does not press the present petitions.

Disposed of as not pressed. However, liberty is granted to the petitioners to get the present petitions revived in case the payment is not released within the stipulated period.
